RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISK & INDEMNITY AGREEMENT

Jubilee Field

PLEASE READ THIS ENTIRE DOCUMENT CAREFULLY BEFORE SIGNING. By signing below, you are giving up certain legal rights, including the right to sue.

1.  Description of Activities - I understand that the event at Jubilee Field (the "Event") includes a variety of outdoor and indoor recreational games and activities, which may include but are not limited to: relay races, sack races, egg and spoon races, three-legged races, obstacle courses, tug-of-war, cornhole, ladder toss, washers, horseshoes, bocce, croquet, oversized lawn and block-stacking games, ring toss, volleyball, kickball, wiffle ball, softball, soccer, flag football, basketball, pickleball, badminton, dodgeball, frisbee and disc throwing, disc golf, throwing and catching games, group fitness, yoga, stretching, social and organized dancing, water games, team competitions, live music, concerts, festivals, and other events; the use of the venue grounds, structures, seating, and equipment; the consumption of food and beverages; movement across natural and uneven outdoor terrain; and any other recreational, athletic, social, spectator, or physical activities of any kind, whether organized or spontaneous (collectively, the "Activities").

2.  Assumption of Risk - I acknowledge and understand that participation in the Activities involves inherent risks of injury, accident, illness, or death, including but not limited to:

•  Slips, trips, and falls on grass, turf, gravel, pavement, or uneven terrain;

•  Sprains, strains, bruises, fractures, or other injuries from physical exertion or contact;

•  Injuries from equipment, props, or materials used in games and activities;

•  Dehydration, heat exhaustion, or other weather-related conditions;

•  Collisions with other participants, spectators, or structures;

•  Any other risks inherent in outdoor recreational activities.

I voluntarily assume all such risks, known and unknown, and accept full responsibility for any injury, loss, or damage that may occur as a result of my participation.

3.  Release and Waiver of Claims - In consideration of being permitted to participate in the Event, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Jubilee Field LLC, it’s affiliated businesses Burwether, LLC and Field Bar, LLC, the Play for a Change KY, their owners, officers, members, employees, agents, volunteers, contractors, and venue operators (collectively, the "Released Parties") from any and all claims, demands, actions, causes of action, or liability of any kind, whether known or unknown, arising out of or in connection with my participation in the Event or the Activities, including claims resulting from the negligence of the Released Parties, to the fullest extent permitted by Kentucky law.

4.  Indemnification - I agree to indemnify, defend, and hold harmless the Released Parties from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to my participation in the Event, including any claims brought by third parties as a result of my conduct.

5.  Medical Authorization - In the event of an emergency, I authorize the Released Parties to seek emergency medical treatment on my behalf and agree to be responsible for all costs associated with such treatment. I represent that I am in adequate physical condition to participate in the Activities and am not aware of any medical condition that would prevent safe participation.

6.  Governing Law - This Agreement shall be governed by the laws of the Commonwealth of Kentucky. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

7.  Acknowledgment - I have read this Agreement in its entirety. I understand its contents and I am signing it freely and voluntarily. I understand that by signing I am giving up legal rights.
